1. Agreement to Terms

By accessing or using the Performix Soccer mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Performix Soccer provides a mobile application and website offering soccer training content, including video-guided drills, workout plans, progress tracking, and related features. The Service is designed to help soccer players of all ages improve their skills through independent practice.

3. User Accounts

To access certain features of the Service, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. Subscriptions and Payments

Free Trial

We may offer a free trial period for new users. At the end of the free trial, you will be required to subscribe to continue accessing premium features.

Subscription Plans

The Service offers various subscription plans with different features and pricing. Details are available within the app and on our website. Prices are subject to change with notice.

Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually). Payment is processed through Apple App Store, Google Play Store, or Stripe, depending on your platform.

Cancellation

You may cancel your subscription at any time through your app store account settings or website account. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

Refunds

Refund requests for app store purchases should be directed to Apple or Google as applicable. For web subscriptions, refunds may be considered on a case-by-case basis within 7 days of purchase.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share your account credentials with others
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Copy, modify, distribute, or create derivative works from our content
  • Use automated systems to access the Service without permission
  • Harass, abuse, or harm other users
  • Upload malicious code or content
  • Impersonate any person or entity

6. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by Performix Soccer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from the Service without our prior written consent.

7. Health and Safety Disclaimer

Important: The training content provided through the Service is for educational and informational purposes only. Before beginning any exercise program:

  • Consult with a physician or healthcare provider, especially if you have any medical conditions
  • Ensure proper warm-up before and cool-down after training sessions
  • Use appropriate safety equipment and train in safe environments
  • Stop immediately if you experience pain, dizziness, or discomfort
  • For minors, parental supervision is recommended

Performix Soccer is not responsible for any injuries that may occur during training activities. You assume all risks associated with using the training content.

8. Third-Party Links and Services

The Service may contain links to third-party websites or services (including equipment stores) that are not owned or controlled by Performix Soccer. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERFORMIX SOCCER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or the like transmitted through the Service
  • Any errors or omissions in any content

11. Indemnification

You agree to defend, indemnify, and hold harmless Performix Soccer and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
